NTEU files grievance over CFPB’s refusal to share pay study with Union

On Friday, August 7, NTEU National filed an institutional grievance over CFPB's failure to provide the pay study done by contractor Ernst and Young. CFPB has told us they are using this pay study as the basis for their pay proposal. CFPB has denied our request to see the pay study and report, even though we need it in order to negotiate. The grievance explains how this violates our union rights under federal labor law:

 

Institutional Grievance - Compensation Information Request Response

NTEU hereby files an institutional grievance in accordance with Article 43, Section 6 of the Collective Bargaining Agreement. NTEU contends that the CFPB has violated the terms of 5 USC Section 7114(b)(4) in its response of July 10, 2020 to NTEU’s request for information (submitted on May 22, 2020, revised June 1, 2020) that is relevant and necessary to negotiations of a new Compensation Agreement.  The CFPB’s refusal to provide this information also constitutes an unfair labor practice under 5 USC Section 7116(a)(1), (5) and (8).

Among the information that the CFPB has refused to provide is the study conducted by, or with the assistance of, Ernst and Young with respect to the CFPB’s salary structure. This study was cited in the briefing conducted on June 10, 2020 as the basis for the proposed changes discussed in that briefing, which management has indicated will constitute a major component of changes it will propose in upcoming negotiations over the Compensation Agreement.  This report is necessary for “full and proper discussion, understanding, and negotiation” of the CFPB proposals as set forth in the briefing documents, and whether and how this study included any consideration or analysis of how the proposed changes would affect the statutory requirements regarding the comparability of CFPB’s pay with that of other financial regulatory agencies.
